The legal bit

Since you're going to be using money from your businesses sales or services towards your fundraising we just need you to agree to the below terms. This is nothing scary but it keeps our lawyers happy and protects everyone involved :)

South Wales - Charity Champions South Wales

This agreement explains the terms on which we are able to allow you to use our name and logo and to take part in and promote Charity Champions South Wales (the Campaign) to your customers, employees and colleagues in order to raise funds for us. It is necessary in order for us to meet our legal obligations as a charity so please read through carefully.

In this agreement you and your means your business (being the name of the business, address and company number (if applicable) that you provide when you sign up to the Campaign) and we, us and our means Bauer Radio’s Cash for Kids Charities (company number 06424810 charity number 1122062) c/o South Wales Cash for Kids, The Wave, Victoria Road, Gowerton, Swansea, SA4 3AB.

  1. By agreeing to participate in the campaign you agree to:

    1. Ensure that when you are raising money from the public you let them know before they make a donation that:
      1. you are aiming to raise at least 0.00 for Bauer Radio’s Cash for Kids Charities a registered charity in England, in connection with the sale of your products or services or other promotional ventures;
      2. you will receive no payment for doing this; and
      3. you will provide this information to them in writing if they request.
    2. Ensure that any activities that you, your employees, customers or contacts promote or carry out to raise money for the Campaign, and any artwork, materials, or promotional literature that you produce preserves our good reputation as a charity and does not bring us or our name or logo into disrepute and is appropriate for raising funds for a children's charity;
    3. Ensure that you obtain any licences or permissions required to carry out the fundraising that you have in mind and have in place valid and appropriate insurance for such activities;
    4. Be responsible for all promotional or marketing activities and their associated costs, which you are happy to meet without deducting such costs from the funds you raise;
    5. If relevant, engage in any direct telephone or email marketing for the purposes of the Campaign in accordance with requirements of the telephone preference service, the Independent Fundraising Standards & Adjudication Panel and the requirements of data protection legislation
    6. Be responsible for ensuring all fundraising activities and events that you carry out for the Campaign are legal and appropriate, recognising that we cannot accept responsibility or liability for activities or events you hold;
    7. Hold all sums that you raise on trust for us until those sums are transferred into our name;
    8. Transfer all sums you have raised by 31-Dec-2030 (the deadline) either via the fundraising page that you have set up on the Cash for Kids "Giving is Easy" website, or pay the funds direct to your site's Cash for Kids bank account, or pay direct by cash or cheque at the site (all donations are non-refundable);
    9. Keep records of all donations you receive, whether online or in person or otherwise and provide a copy to us if requested;
    10. Promptly transfer to us any sums which you receive or become aware of after the deadline;
    11. Abide by the Code of Fundraising Practice in relation to your fundraising activities and the way in which you engage with members of the public, to the extent applicable in . This means in particular:
      1. letting us know if you receive any complaints in relation to activities you carry out to raise funds for us, the nature of the complaint and what you did to resolve the complaint; and
      2. ensuring you do not apply any undue pressure on members of the public or make persistent requests to make a donation, especially if you think they might be vulnerable;
    12. Not act in a way that suggests that you represent us; and
    13. If we request, stop your fundraising activities and transfer any funds raised to date to us using the bank account details provided above (at which point you and we will treat this agreement as terminated).
  2. In return for you abiding by this agreement we agree to allow you to use our name and logo in the United Kingdom for the duration of the Campaign, in connection with your promotional, fundraising and marketing activities for the Campaign. Please contact us for confirmation of the guidelines you must follow when using our name or logo.
  3. You accept that if you don't transfer any donations raised by the deadline and after we have prompted you, you do not transfer any such donations within a further 15 days without reasonable reasons, we can seek to recover such donations from you, and you agree to meet our costs in doing so.
  4. You accept that once the Campaign has finished (or this agreement has terminated, whichever the earlier) you will no longer be permitted to use our name and logo for any purpose.
  5. This agreement contains the full agreement between us and you and we acknowledge that no other promises or representations have been made between us.
  6. Any communication with you will be sent to the address that you registered with us when you agreed to participate in the Campaign. You can contact us at any time at the address provided above.
  7. This agreement is governed and interpreted in accordance with Scots law and the courts of Scotland have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with this Agreement.
  8. On the date that you click ‘Agree’ [at the end of this agreement] you confirm that you have read and agree to be bound by this Agreement .
